Terminology

For the purposes of this agreement (the 'Agreement'), the Platform is referred to as 'we', 'us' or 'our'. Users and other visitors to the Platform are referred to as 'you', 'your' or 'User'. Together, 'we' and 'you' are collectively referred to as the 'parties' and individually as a 'party'.

Processing and Retention Period for Personal Information

We will handle and retain your personal information for as long as required by law, or for the period agreed when we collected it from you.

Generally, we retain your personal information for 18 months after you delete your account or if your account is deactivated for misuse. This period allows time for any reviews by financial institutions or investigations by authorities. This Agreement applies to all Users who trade on the Forrest Gainlux Global website and its mobile application (the 'Platform'). Users must comply with the terms and conditions set out in this Agreement, in accordance with applicable laws and regulations governing personal information and data protection in their respective country or region.

Invocation

Any reference in this Agreement to codes, statutory instruments, or administrative regulations is to the latest amended version, whether the amendment occurred before or after this Agreement was executed

Headings in this Agreement are provided for convenience only and must not be used to interpret the terms and conditions. Any reference to statements, terms, conditions, annexures or schedules is a reference to those contained in this Agreement.

Guidance on the Use of the Term 'Include'

In this Agreement, the term 'include' means 'including but not limited to', unless stated otherwise.

Information Collected

Users agree that the Platform may use cookies to monitor their activity on the Platform and collect a range of information, including IP addresses, geographic locations, and other relevant data. For example, we may use video (including audio) recordings to verify the identity of P2P merchants and as evidence in P2P order disputes. Additionally, facial video (including audio) data may be used for Forrest Gainlux identity verification on third-party platforms..

Limitation of Liability

Although the Platform implements technical and security safeguards to protect your information, we cannot guarantee that data transmitted over the internet is 100% secure. Accordingly, we do not warrant the security of the personal information you submit, and we cannot be held liable for any loss or damage arising from unauthorised access to your personal data.

Updates to this Agreement

We reserve the right to update this Agreement at any time. If we update the Privacy Policy, we’ll notify you by posting the changes, including the new effective date and details of the updates. In some instances, we may also send you a direct notice. Please review the Privacy Policy regularly. By continuing to use the Platform after any changes take effect, you agree to the updated terms.
